1. Nature of the Product

1.1. MoodleGPT 3 ("the Product", "the Extension", "the Service") is digital content within the meaning of Article 2(11) of Directive 2011/83/EU (Consumer Rights Directive).

1.2. The Product is a browser extension that provides AI-powered educational assistance features for Moodle learning management system users.

1.3. The Product is delivered electronically and immediately upon successful payment processing.

3. Digital Content Delivery

3.1. Immediate Delivery: The Product is delivered immediately upon successful payment through automatic license activation.

3.2. Delivery Confirmation: Delivery is deemed complete when:

  • The payment is successfully processed;
  • The license key is activated and stored in your browser;
  • The extension features become accessible.

4. Right of Withdrawal and Express Waiver

IMPORTANT - PLEASE READ CAREFULLY

4.1. Standard Withdrawal Right: Under normal circumstances, consumers in the European Union have a 14-day withdrawal right ("cooling-off period") for distance contracts involving digital content.

4.2. Exception for Immediate Digital Delivery: According to Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to: "the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal".

4.3. Your Express Consent and Waiver: By completing the purchase process, you:

  • (a) Expressly request that we begin providing the digital content immediately upon payment;
  • (b) Acknowledge that once the digital content has been fully provided, you will lose your right of withdrawal;
  • (c) Confirm that you understand this waiver.

5. License Grant & Restrictions

5.1. Upon successful payment, you are granted a non-exclusive, non-transferable, personal license to use the Product.

5.2. You may NOT:

  • Share, resell, sublicense, or transfer your license to any third party;
  • Circumvent or attempt to circumvent any license verification mechanisms;
  • Use the Product for any illegal purpose;
  • Reverse engineer, decompile, or attempt to extract the source code.

6. License Revocation

6.1. Your license may be immediately revoked without refund if you:

  • (a) Initiate a chargeback or payment dispute that is resolved in our favor;
  • (b) Violate any term of this Terms of Service;
  • (c) Engage in fraudulent activity;
  • (d) Share, sell, or distribute your license credentials.

7. Refund Policy

7.1. General Policy: Due to the nature of digital content and your explicit waiver of withdrawal rights, refunds are generally not available after delivery.

7.2. Exceptions: At our sole discretion, we may consider refunds for:

  • Duplicate purchases (within 24 hours);
  • Documented technical impossibility preventing usage (within 48 hours).

8. Governing Law

These terms are governed by the laws of Portugal. EU mandatory consumer protection provisions apply.
